Tolkien Estate undermines new 'JRR Token' cryptocurrency

Tolkien Estate, the legal entity which manages the estate of John Ronald Reuel (J.R.R.) Tolkien, has successfully taken down the domain name “jrrtoken.com”.

The “JRR Token” is a new cryptocurrency which launched in August 2021 with the tagline “The One Token That Rules Them All”. The creator of the new cryptocurrency even managed to get actor Billy Boyd, famous for playing Pippin in the Lord of the Rings movies, to promote the coin in a Cameo video. Very soon after the launch of the coin, the Tolkien Estate initiated arbitration proceedings at WIPO in order to transfer the domain name.

The Tolkien Estate was able to argue that the domain name infringes upon their trademark rights. The coin’s creator was not able to demonstrate any rights or legitimate interests, whereas the Tolkien Estate was able to prove that the domain name was both registered and used in bad faith. The arbitration panel concluded that the coin’s creator attempted to create a false association with the Tolkien Estate, creating a likelihood of confusion with regard to the Tolkien trademarks, and also tried to profit from Tolkien’s reputation. The panel did not accept the argument of the coin’s creator that the domain name was merely being used as a humorous parody.

Following this decision, the Tolkien Estate has obtained the disputed domain name, which has now been taken down.
